Many employers use criminal background checks to screen job applicants or employees applying for promotions. While considering criminal conviction records can benefit a company, it can also cause harm if the use of criminal conviction information does not comply with the law. The recent uptick in litigation, penalties and settlements in this area suggests that most employers are not compliant.
