Dean Andrew 2019 029 ROC 8X10HSE attorney, Andrew M. Dean, was featured in a recent Daily Record article titled, “Negligence claims are common in business world, as area Dunkins learn.” The article details the increase in personal injury lawsuits filed against Dunkin Donuts in the US, including five claims filed locally against Rochester Donuts, Inc. Andrew states, “Any business that has been around for more than a year will start experiencing incidents like this.” It’s best to be prepared, “If you’re insured, you’re probably not going to be crushed by an incident like this… make sure you also have workman’s comp insurance. A significant number of slip-and-fall claims come from your own employees.” Andrew also recommends store managers do their best to document incidents, “The manager needs to make an incident report,” he continues, “Four years later, memories fade, so if you have a report from the day of the incident, you could kill the claim, and if not kill it, you may get the plaintiff’s attorney to settle for five figures instead of six.”
