Hiscox Must Fund NY Drug Biz’s Defense in Opioid Trial

HSE attorneys, Patrick M. Tomovic, Brian M. Feldman, and Lauren R. Mendolera, were mentioned in a recent Law 360 article titled, “Hiscox Must Fund NY Drug Biz’s Defense in Opioid Trial.” The HSE team serves as litigation counsel for Rochester Drug Co-Operative Inc (RDC). Through litigation in the U.S. District for the Western District of New York, RDC has sought coverage from Hiscox Insurance Company (Hiscox) for the costs of a legal defense in multi-plaintiff opioid-related litigation.  The article describes the opinion issued by U.S. District Judge Elizabeth A. Wolford, explaining why RDC was entitled to a preliminary injunction requiring Hiscox to fund RDC’s legal costs.
