Local Businesses Feel Some Relief After Hearing Mandate Details and Employee Responsibility

McCarthy, local employers and associations weighed in on OSHA’s newly effective temporary emergency standard, which requires businesses with 100 or more employees to require vaccination or weekly COVID-19 testing for most employees. Anna provided insight on whether there will be a legal challenge to the guidance. She does anticipate there may be legal challenges to this rule, which could relate to OSHA’s authority to issue emergency rules that are meant to address something that poses a grave danger to employees. Regardless of the possibility of legal challenges, she noted that employers should still begin preparing to meet the rule’s fast-approaching deadlines.
