Seek Protections from Landlord Before Signing a Sublease

HSE Real Estate partner, John A. Anderson, was featured in a recent Daily Record article titled, “Seek Protections from Landlord Before Signing a Sublease.”  The article focused on sublease options for companies looking to get out of their leased space now that more work-from-home arrangements are desired.

When describing the sublease alternative, John noted, “Often people will enter a sublease because they think it’s easier.”  As a safeguard, John continues, “See if you can pay rent directly to the landlord, …. that way if the sub-landlord defaults, you’re still paying for your space.  The more proactive you can be as a subtenant, the better.”
