Michael Roche, senior associate in the firm’s Cannabis Law and Corporate practice groups, was recently interviewed in a CITY News article titled, “Where the T-shirts are pricey but the pot is ‘free’.” The article discusses a workaround one local retailer is using to “gift” marijuana to customers and the possible legal implications of this practice. Michael had not heard of many businesses in New York “gifting” and that he would not recommend it. “If you think of the way alcohol law works, and cannabis law is very heavily inspired by alcohol law, you can’t give away alcohol without a license.”
