New COVID-19-Related Skilled Nursing Facility Requirements Issued

Nursing homes have received a great deal of media attention in recent weeks in connection with the ongoing COVID-19 pandemic. In response, last week the Center for Medicare & Medicaid Services (CMS) announced the issuance of new requirements for the notification of families of nursing home residents of the conditions in nursing homes, including suspected and confirmed COVID-19 cases.

The CMS memorandum provides that the notification mandate extends to the families of all residents in the facility, and not just to the suspected or confirmed resident’s family. Also, in addition to existing regulatory requirements that state and local health departments be notified of certain cases of infectious disease, facilities must now also notify the federal Centers for Disease Control and Prevention.
