Michael J. Berchou and Brian B. Shaw Named to The Daily Record Power 20 Intellectual Property List

Berchou, a partner in the Litigation and Intellectual Property practices, has served as lead counsel on multiple patent, trade secret, trademark, and copyright cases in district courts across the country, as well as Inter Partes Review (IPR) and Ex Parte Reexamination proceedings at the Patent Trial and Appeal Board, appeals to the Federal Circuit, and numerous opposition and cancellation proceedings at the Trademark Trial and Appeal Board. A registered patent attorney and electrical engineer, Berchou has represented clients as both plaintiffs and defendants in diverse technology areas, including data center cooling, medical devices, vibration sensors/accelerometers, computer storage and network connectivity, live streaming, exhaust gas recirculation systems, ballistic fabrics, and artificial turf.

Berchou is a board member of Road Less Traveled Productions and Literacy Buffalo Niagara. He has been recognized by Chambers USA for his litigation work, was named to the Legal Elite of Western New York list by Buffalo Business First in 2017 and 2020 and is AV Preeminent Peer Review Rated by Martindale-Hubbell. He received his B.S. and M.B.A. degrees from the University at Buffalo and his J.D. from the University at Buffalo School of Law.

Shaw, a partner and chair of the Intellectual Property practice group, counsels clients on patents, trademarks, copyrights, and trade secrets. He prepares and prosecutes patent applications, prepares patentability opinions, patent infringement opinions, identifies and clears products through infringement and design-around issues, and counsels on and prepares licensing and technology transfer agreements. His diversified experience includes computer law, mechanical intellectual property, biomedical technology, new media law, international intellectual property, and more.

Shaw is past president of the Rochester Intellectual Property Law Association and a member of the Monroe County Bar Association, New York State Bar Association, California State Bar Association, District of Columbia Bar Association, and the International Trademark Association. He has been recognized by his peers for inclusion in The Best Lawyers in America® for Copyright Law; Litigation – Intellectual Property; Litigation – Patent; and Patent Law and he was named as Best Lawyers® Litigation – Patent “Lawyer of the Year” for Rochester, New York, in 2019 and 2021. He received his B.S. in Mechanical Engineering from Yale University and his J.D. from Cornell Law School.
