The Writing Process for Investigators: Title IX and Enough is Enough Investigation Reports

Harter Secrest & Emery LLP - 13th Floor
1600 Bausch and Lomb Place
Rochester, NY 14604

October 31, 2019
8:30 am - 1:30 pm

During investigations, you plan and conduct investigation interviews; evaluate documents, drawings, law enforcement reports, hospital records, emails, and photos; review Snapchat, Instagram, Facebook, and text messages; listen to recordings; and watch videos. What happens next? You have to assess all of this information and synthesize and summarize it in an Investigation Report that the decision-maker(s) on your campus will rely upon to make a determination of responsibility.

We quite frequently are asked how investigators move from the collection of information stage of the investigation process to the report writing stage of the investigation process. In response to your requests, Harter Secrest & Emery's Higher Education Practice Group is offering a program that focuses exclusively on the report writing stage of the process.

  • How do you decide what information to include in the report?
  • What information does the decision-maker need in the report?
  • When is it adequate to keep information in its original form as an attachment to the report without separately highlighting it in the report?
  • How do you avoid the decision-maker searching for relevant information somewhere in the attachments?
  • How do you go about the physical process of writing?
  • What writing skills are important to ensure your report is professional, equitable, reliable, concise, and clear?

Important Note: In order to get value out of this interactive and intensive program, we will send you documents before the program that we need you to read and understand before the program. In our experience, our program attendees often skip this step due to other demands on their time, but it is essential. The value of the program depends upon your ability to understand, discuss, and apply the material we will send to you before the program. We cannot work on investigation report writing without first understanding the substance of the information gathered during the investigation.
