Jeff strategizes from the very beginning of a case to position his clients for success and excels at making the most powerful arguments to the courts. Jeff has represented clients in state and federal trial courts around the country, and has significant appellate experience.

Drawing on his experience as a former attorney with Gibson Dunn & Crutcher LLP in Washington D.C., and as a former counsel to the Assistant Attorney General in the U.S. Department of Justice’s Civil Division, Jeff effectively counsels individuals and businesses of all sizes on a wide range of business litigation, antitrust, and constitutional issues.

Jeff currently leads the Antitrust practice group and serves on the Firm’s Management Committee. He has previously served as the Firm’s Hiring Partner and as leader of the Commercial and IP Litigation practice group.

REPRESENTATIVE EXPERIENCE

Business and IP Litigation

  • Progressive Sterilization v. Turbett Surgical (D. Del. 2021) — Represented a medical device manufacturer and inventor defending against patent infringement, trade secret misappropriation, and related claims in federal court in Delaware. Negotiated settlement after successfully obtaining dismissal of majority of claims.
  • Quintel Technology Ltd. v. Huawei Technologies Co. (E.D. Tex. 2018) — Served as lead trial counsel for a telecommunications technology company plaintiff in a case alleging misappropriation of trade secrets, breach of a non-disclosure agreement, fraud, and joint inventorship of a patent. The case was successfully settled on the sixth day of a jury trial in federal court in the Eastern District of Texas.
  • Giftcraft, Inc. v. K&K Interiors, Inc. (N.Y. Monroe Cty. 2015) — Represented a wholesale home décor and gift company in its claims against a competitor and former sales representatives for tortious interference and breaches of non-solicitation agreements.
  • TuitionFund, LLC v. First Horizon Nat’l Corp. (M.D. Tenn. 2014) — Represented a technology company and four financial institutions in a case alleging infringement of financial industry business method patents.
  • Pictometry International Corp. v. Blom ASA (2011-2012) — Served as lead counsel in an international license dispute conducted under ICC arbitration rules seated in London, with collateral litigation in Oslo, Norway and Rochester, New York.
  • Laboratory Corp. of America v. Metabolite Laboratories, Inc. (S. Ct. 2006) — Participated in the successful representation of the prevailing party to preserve a Federal Circuit ruling upholding the validity of a two-step process patent setting forth a method for diagnosing vitamin deficiencies.*

Antitrust

  • Meyer v. Kalanick (SDNY 2016) — Represented an Uber user and a putative class of all U.S. Uber riders against Uber’s CEO for unlawfully fixing prices in violation of Section 1 of the Sherman Act.
  • Abbouds’ McDonald’s LLC v. McDonald’s Corp. (9th Cir. 2006) — Participated in the successful representation of a national franchisor against claims of bid-rigging.*

Constitutional Law

  • Caplash v. Johnson (W.D.N.Y. 2017) — Successfully challenged on due process grounds the federal government’s denial of a citizen’s immigration-related petition.
  • Holland v. Goord (2d Cir. 2014) — Successfully advocated for the First Amendment rights of a Muslim inmate.
  • Dandamudi v. Tisch (2d Cir. 2012) — Successfully challenged the constitutionality of New York State professional licensing statutes that discriminated against H-1B visa holders.
  • Bush v. Gore (S. Ct. 2000) — Participated in the successful representation of George W. Bush and Richard B. Cheney in the aftermath of the 2000 presidential election.*
