As a regulatory compliance and corporate attorney, Jennie Shufelt advises health care and non-health care clients on a wide range of corporate and transactional matters, and assists clients in navigating highly regulated industries such as health care. Jennie utilizes her broad healthcare and legal industry experience to help clients maximize opportunities while minimizing and resolving risks.

Health Care
Jennie represents health care providers on operational, compliance, transactional and governance matters. Her experience includes guiding clients through audits by the Office of the Medicaid Inspector General (OMIG) and investigations by state agencies such as the New York State Attorney General’s Medicaid Fraud Control Unit; developing and evaluating provider compliance programs and assisting clients with compliance program reviews conducted by the OMIG’s Bureau of Compliance.

She advises a range of health care providers including assisted living facilities, certified home health agencies, licensed home care services agencies, nursing homes, transportation providers and managed care plans.

Corporate
Jennie’s Corporate practice includes advising for profit and not-for-profit health care and non-health care clients in a variety of industries on day-to-day, transactional and corporate matters including formation, contracting, mergers, acquisitions and sales, commercial real estate transactions and leases, and corporate governance.

Prior to joining Harter Secrest & Emery, Jennie was a principal with Hinman Straub, P.C. in Albany, New York.

Health Care

  • Represented numerous Medicaid providers in defending OMIG audits, from audit initiation through administrative hearings and Article 78 proceedings.
  • Designed multiple Medicaid compliance programs for various health care providers, and provides ongoing implementation and compliance-related assistance to health care clients, including through the provision of compliance training and internal auditing assistance.
  • Successfully defended/resolved several audits and investigations of health care clients against Attorney General / MFCU investigations.

Corporate

  • Represented numerous clients in the sale or acquisition of health care provider operations and related real estate.
  • Facilitated the establishment of business corporations, limited liability companies, professional corporations and professional limited liability companies, from formation to the negotiation and execution of governing documents and related policies and procedures.
  • Represented multiple clients in the negotiation and completion of commercial real estate transactions and commercial leases.
  • Assisted clients with transactions involving public-private partnerships and economic development components.
