Kristian provides counsel to health care providers, hospitals, physician practices, nursing homes, and other health care facilities on operational and governance matters, including professional licensure and misconduct issues, patient-related issues, medical staff issues, and psychiatric commitment issues. Kristian also assists health care entities with regulatory and compliance matters concerning corporate compliance, HIPAA, fraud and abuse, and the implementation of internal compliance programs.
Health Care Investigations
With a background in litigation and in-depth knowledge of government and internal investigations, Kristian advises health care clients regarding Medicare and Medicaid voluntary self-disclosures, reimbursement issues and appeals, Stark Law, the Anti-Kickback Statute, and Civil False Claims Act issues. Kristian also guides clients through audits, investigations and other interactions with government departments and agencies including the New York State Department of Health (DOH), Office of Inspector General (OIG), U.S. Department of Health and Human Services (HHS), United States Attorney General, Medicaid Fraud Control Unit (MFCU), Department of Justice (DOJ) and Office of the Medicaid Inspector General (OMIG).
Corporate and Higher Education
Kristian assists corporate entities with business acquisitions and sales, as well as formation, governance, ownership, operation, transfer, and termination of such entities. Kristian also has experience with advising higher education institutions on legal compliance, dispute resolution and student affairs.
Before joining HSE, Kristian worked in commercial litigation at Webster Szanyi LLP. She also assisted the FBI legal and criminal investigations departments in conducting internal investigations, as an honors intern with the FBI in Washington, D.C., defended and counseled individual clients in criminal proceedings in state court, and analyzed healthcare legal issues as a legal intern at a national health care system and insurer.
